What is Gender Discrimination?
Gender discrimination can occur when an employer terminates or otherwise discriminates against an applicant or employee in the promotion, compensation, or in any terms, conditions, or privileges of employment or licensing on the basis of sex.

Gender Discrimination & Hiring
In order for an applicant to bring a claim against an employer for gender discrimination relating to hiring, or the employer’s failure to hire the applicant, the applicant must be in a protected class, have applied for the job, been qualified for the job, and was denied the job under circumstances which gave rise to an inference of unlawful discrimination.
Failure to Promote Due to Gender Discrimination
In order for an employee to bring a claim against an employer for gender discrimination relating to being passed over or denied a promotion, the employee must be in a protected class, rejected, passed over, or not selected for the promotion, and an individual of the opposite sex received the promotion who was less qualified.
Reverse Gender Discrimination
The sex discrimination provisions of Title VII and the Wisconsin Fair Employment Act apply to males as well as females.
