What is FMLA?

The Family and Medical Leave Act (FMLA) entitles an employee to take up to 12 work weeks of job-protected, unpaid leave, or substitute appropriate paid leave if the employee has earned or accrued it, per year to:

  • Care for a newborn son or daughter
  • Adopt or foster a child
  • Care for a spouse, son, daughter, or parent with a serious medical condition
  • Recover from his or her own serious health condition if it interferes with his or her ability to perform at work

In addition, an employee may take job-protected leave for up to a total of 26 work-weeks per year to care for a covered service member with a serious injury or illness. In certain cases, FMLA leave may be taken at intervals rather than all at once. Or, an employee may work a part-time schedule.

The Wisconsin Family and Medical Leave Act (WFMLA) provides similar protections and entitlements to employees as the FMLA.
